1. General provisions

These terms apply to the purchase of products or services on the website www.melba.is.
The terms define the rights and obligations of Melba on the one hand and the buyer of goods or services on the other. If these terms and conditions have not been accepted upon new registration on the melba website, they are considered accepted upon the first purchase of a product or service. "Buyer" is a person who is a party to a contract but does not engage in business or other business activities, i.e. a person who buys a product or service within the meaning of the Act on Consumer Purchases no. 48/2003. Buyer must be at least 16 years old. "Purchaser" can also be a legal entity, but Act on the purchase of services no. 42/2000 apply to companies and institutions. This law applies to the legal status of the contracting parties when the special provisions of these terms and conditions are waived. Melba sells products or services to the buyer on its website. Melba invites the buyer to have the product delivered to their home, see delivery methods in section 6.

2. Information and prices

Prices on Melba's website and in mails include VAT and are published subject to typing errors, typographical errors and image errors. Melba reserves the right to cancel orders in whole or in part if the relevant product is sold out, damaged or defective. Melba will inform the buyer about all such as soon as possible, and possibly make a proposal for another product that the buyer has the opportunity to accept or reject. The seller reserves the right to change the price of a product without notice, but prices generally vary due to competition and supplier price changes.

3. Personal information

All personal information is treated as strictly confidential and used only for the purpose of completing business transactions. Information will not be passed on to third parties under any circumstances.

4. Access
The buyer is allowed to use Melba and the services offered there in accordance with these terms and the access restrictions set by Melba. Falsifying your name and personal information when registering on melba.is is strictly prohibited.

Melba reserves the right to work closely with the police in solving such cases, including providing them with the necessary information. If the buyer is exposed to fraudulent activity when purchasing on melba.is, it will be reported to the police. Melba reserves the right to limit or block access to melba.is if it is suspected that the buyer has been found to have faked his name and personal information during registration.



5. Order and payment

Once the buyer has confirmed the order on Melba's website, it is considered binding between the parties. The buyer will receive an order confirmation sent to the email address provided during the order. The buyer is advised to study the order confirmation carefully when it arrives. You can pay by credit card, the amount is debited when the order is processed from stock.

6. Delivery
During the purchase process, the buyer chooses a shipping method, but shipments are processed anywhere from 1-7 days after payment has been received. Melba ships all of its products in quality packaging to ensure that they reach customers intact.

Melba's carriers are Dropp ehf. and the applicable delivery, warranty and transport terms of Dropp ehf. about the delivery of the product.

Price for shipping by Drop:

-In the capital area ISK. 790 with VAT

-In other places ISK. 990 with VAT

-If home delivery is selected, the cost is ISK. 1,350 in the capital area and ISK. 1,450 in the southwest corner.

7. Product premium

After the buyer has received the order, he must check whether it is in accordance with the order confirmation and the invoice. These terms assume that the buyer has read and familiarized himself with the instructions that come with the product. If the buyer believes that the product is not in accordance with the product description or more detailed instructions are needed with the product, a notification to that effect should be sent by e-mail to melba@melba.is .

Melba store reserves the right to verify a statement within 14 days.

8. Defects

If a product is defective, Melba is obliged to offer the buyer a new product or to cancel the purchase. According to the law on consumer purchases no. 48/2003, the buyer has the right to have a defective product repaired if we are notified within two months of the buyer becoming aware of the defect. Melba recommends that the buyer sends an e-mail as soon as a defect is discovered.

9. Agreement

By paying, the buyer confirms that he knows the current terms and conditions of the online store melba.is. Each purchase is binding for the buyer according to the terms and conditions of the online store.

10. Payment

In Melba's online store, prices are stated in Icelandic króna and include 24% VAT. Shipping costs will be added before payment is made.

The buyer is offered to pay with all major payment cards, as payments go through the secure payment gateway Teya Iceland hf.

11. Right of return

Buyers who shop at melba.is have 14 days to cancel the purchase, provided that the product has not been used, it is returned in perfect condition and in original packaging. When returning a product, it is based on its original price, unless the relevant product is on sale or on a special offer when returning the product. Then the price of the product is based on the day it is returned. If a product is sealed, the seal must not be broken. The return period starts from the time the product is purchased.

The invoice for the product purchase must be included with the product return. Refunds are made in full if the above conditions are met and after the product is received. Shipping and postage charges are non-refundable. It is important to us that customers are satisfied, so we encourage customers to send to the e-mail address melbaðurður@gmail.com if they think that the purchase is not satisfactory.

In other respects, we refer to Act no. 48/2003 on consumer purchases.

12. Ownersh
Sold products are the property of Melba until the purchase price is paid in full. All copying of footage from melba.is and other media is prohibited.

13. Other
Melba store reserves the right to change the provisions of these terms and conditions, as long as the buyer is notified. Broadcasting of new terms to the buyer and/or publication on the melba.is website is considered sufficient notification. The buyer is considered to have accepted the change if he buys a product or service after a change notice has been issued.

14. Disputes

If a dispute arises between the parties regarding the content of these terms and conditions or due to a violation of them, the relevant case can be submitted to the Complaints Committee for Services and Purchases of Liquid Assets at the Consumer Agency. If everything is urgent, it is permitted to prosecute a case for this before the Reykjaness District Court according to the provisions of law no. 91/1991.

15. Validity period

These terms apply from 1 June 2024
